New Colorado Law Providing Employee Access to Personnel Files and Records

Beginning on January 1, 2017, employees in the private sector will have the right to inspect and obtain a copy of their personnel files and records.  Private employers will be required to provide access at least annually to current employees who make the request.  Former employees will also have a one-time right to inspect their personnel file after the termination of their employment.  The new law allows the employer to require that employees pay reasonable copying costs.

Preparing for the New Overtime Rules

On May 18, 2016, the United States Department of Labor announced its final determination with regard to President Obama’s Directive to “update and modernize” the regulations governing the exemption of executive, administrative and professional employees from the minimum wage and overtime pay protections of the Fair Labor Standards Act (“FLSA”).  Employers have been watching this rule change process carefully, as the new regulations will now require employers to track employee hours with greater accuracy and require them to be particularly careful in properly classifying individuals presently paid a salary.
